In case nomination is not made by the sole account holder, the securities would be transmitted to the account of the legal heir(s), as may be determined by an order of the competent court. This can be quite legally elaborate since the court has to be fully convinced so there will be an ad in the Gazette and only if no claimant comes forward in a certain period of time will the shares be transmitted. That is why nomination is so important. However in cases where the value of securities to be transmitted is less than Rs. 1,00,000/- the DP may process the request based on submission of a necessary letter of indemnity, surety, affidavits, and NOC documents. This is done to simplify the process for small demat value accounts.
