Section (203) of Income Tax Act, 1961, mandates any company or employer, who deducts tax from an employee’s salary to issue a Form 16 to the employee.

The employer must issue Form 16 to the employee before June 15 for the financial year that ended on March 31 of the same year.

However, if the employer fails to give its employee his/her Form 16, then the employer will be liable to pay a penalty of Rs 100 for each day’s delay, post June 15.

Please note, if after repeated requests, you haven’t been issued one, you can file a written complaint with your ***essing Officer, who supervises your IT returns.
