Are Bharti and Vodafone planning to take the TRAI order to TDSAT?

While Vodafone Idea has already approached the TDSAT against the TRAI order on exclusive service packages, Bharti Airtel is also expected to move the TDSAT. TRAI had issued an order last week blocking the premium plan offering of Bharti and Vodafone, which offered faster data speeds and priority services to high-value post-paid customers.

TRAI had stayed Airtel and Vodafone’s premium plans, citing violation of service norms as well as the possibility that it may result in lower data speeds for subscribers outside the exclusive club. This was against the basic tenets of net neutrality. It may be recollected that a similar exclusive plan by Facebook was also struck down on the same grounds.

However, the telecom companies and the COAI have argued that such differentiated plans already exist for broadband services. In this case, subscribers get better speeds for schemes with higher ARPU. The TRAI’s argument has been that since telecom service entails the use of spectrum, which is the property of the people, such prioritization cannot be allowed.
